This service allows you to verify all those requirements necessary for the recognition of civilian invalidity, civilian blindness, deafness, disability and handicap. It is aimed at Italian and foreign citizens. An introductory medical certificate is required.

What is it?

The health assessment aims to verify the fulfilment of the requirements for: 

  • civilian invalidity;
  • civilian blindness;
  • deafness;
  • disability; 
  • handicap.

 

Who is it aimed at?

The following may submit a claim: 

  • Italian citizens residing in Italy;
  • EU foreign citizens legally residing in Italy and registered in the registry office of their municipality of residence;
  • non-EU foreign citizens legally residing in Italy with a residence permit of at least one year (Article 41 of the Consolidated Law on Immigration). 

How does it work?

To start the process of assessment of the status of civilian invalidity, civilian blindness, deafness, handicap and disability, it is necessary to: 

  • go to a certifying doctor
  • claim the issue of the introductory medical certificate.

The certificate shall indicate: 

  • your personal data; 
  • the tax identification code; 
  • the exact nature of the invalidating pathologies and their diagnosis.

The certifying doctor, using the dedicated service: 

  • fills in the certificate online and forwards it to INPS; 
  • prints a receipt, complete with the unique number of the activated procedure certificate.

The receipt is delivered by the doctor to the interested party together with a copy of the original medical certificate, to be exhibited at the time of the medical examination. 

For the submission of a claim for civilian invalidity, the introductory medical certificate is valid for 90 days

The health assessment is carried out by a medico-legal commission

  • at the Local Healthcare Units, with an INPS doctor; 
  • at the INPS medico-legal centres, in the regions that have signed the protocol for the entrustment of health assessments to INPS (so-called CIC Conventions). 

In case of non-transportability

  • the certifying doctor (who does not need to be the one who certified the invalidity) fills in and sends online the medical certificate requesting a home examination, at least five days before the examination date previously set; 
  • the President of the Medical Commission, within five days of the request, informs the citizen of the date and time of the home examination or a new date for an outpatient appointment. 

In case of impediment, the interested party is summoned a second time, if he/she does not show up on the set date. Any further absence will be considered a waiver and will cause the claim to lapse

At the examination, the interested party can be assisted by a doctor of his/her trust. 

At the time of the examination, the citizen must deliver to the Commission: 

  • copy of a valid identification document;
  • the health documentation in his/her hands. 

The Commission shall fill in the examination report in electronic format and send it to the person concerned in duplicate: 

  • one with all health data, including sensitive data;         
  • the other with the final opinion only. 

For health reviews (Article 25, paragraph 6-bis, Law 114/2014), calling an examination is the responsibility of INPS. 

In the event of impairments that may change over time, the report will also indicate the date by which to undergo a new review examination. 

In the case of a recognised invalidity percentage of more than 74%, the claimant may be entitled to a financial benefit, if he/she also meets legal administrative requirements.

The law provides for: 

  • financial benefits (pensions, grants, allowances); 
  • certain non-financial benefits (tax benefits, healthcare assistance, permits pursuant to Law 104/1992, mandatory work placement). 

Claim

After obtaining the introductory medical certificate, the claim can be submitted: 

  • directly online on the INPS website; 
  • through the patronage institutes or a category association for disabled people (ANMIC, ENS, UIC, ANFASS). 

In the case of a minor, his or her credentials should be used and not those of the parent or guardian. 

It is not possible to submit a new claim for the same benefit (with the exception of claims for aggravation – Law 80/2006): 

  • before the end of the current procedure; 
  • before the issuance of a final judgment, in the event of a legal action.

After accessing the online service with personal credentials, it is possible to send the updated health documentation to INPS (Article 29-ter, Law 120/2020). 

The "Civilian Invalidity Health Documentation Attachment" service can be used: 

  • by subjects with a health report indicating a review date
  • by those who have submitted a claim at first instance or for aggravation, resident in the territories where the INPS carries out the health assessment under a convention with the Regions.

It is expected that the service will be extended throughout the territory and to other types of users. 

In the event of a review, the interested party receives at home an invitation letter to transmit the health documentation online, useful for the issuance of the medico-legal opinion. 

Once the appropriate documentation has been received, the Medical Commission issues a new report. 

Otherwise, it calls the interested party for a review examination by registered letter with acknowledgement of receipt. 

If the Medical Commission considers that the impairments are likely to change over time: 

  • the minutes will indicate the date by which to undergo a new review examination
  • the new review examination will be carried out directly at an INPS Medico-legal Centre
  • the previous report remains valid for all legal purposes until the conclusion of the health review. 

Ministerial Decree of 2 August 2007 (Ministry of Economy and Finance and Ministry of Health): 

  • indicates the pathologies and impairments excluded from review; 
  • indicates the appropriate health documentation to be requested of the interested parties or the Medical Commissions (if not already on record). 

At the time of the claim, a request is made to state in advance the socio-economic information necessary for the granting and allocation of civilian invalidity benefits. 

Once the health requirement has been acquired and the administrative ones have been verified, it will be possible to immediately arrange the payment of the benefit and thus considerably reduce waiting times. 

In the case of minors, however, socio-economic data (Form AP70) shall be communicated after the final report is sent.
