What is it?

It is a one-offallowance granted on a claim of the insured's survivors, whose pension benefits would have been settled exclusively according to the contributory system, in the event that, at the time of the recipient’s death, the insurance and contributions requirements for the survivors' pension are not met (Article 1, paragraph 20, Law No. 335 of 8 August 1995).

Who is it aimed at?

It is aimed at the family members of the deceased insured, holders of a pension benefit calculated according to the contributory system.

 

How does it work?

The one-off allowance is paid for an amount:

  • equal to the monthly amount of the Social Allowance, in force at the time of the insured's death, multiplied by the number of years of paid contributions;
  • calculated in proportion to the weeks covered by the contributions, for periods of less than one year;
  • distributed among the beneficiaries on the basis of criteria applicable to the survivor's pension.

In the event that a survivor is not entitled to the allowance because he/she is a recipient of an INAIL annuity or because he/she has income above the established limits, the entire allowance shall be distributed among the other survivors who are entitled to it.

 

Claim

REQUIREMENTS

The allowance can be paid to the survivors (as indicated for the pension) provided that:

  • there are no insurance and contribution requirements for an indirect pension;
  • there is no right to annuities for accidents at work or occupational illnesses, as a result of the insured’s death;
  • the income requirements referred to in Article 3, paragraph 6, of Law No. 335/1995, are met at the date of death of the insured;
  • there is no right to an indirect supplementary pension since there is no right to a survivor's pension paid by a successor, exclusive or exempt fund of the Compulsory General Insurance (AGO).

The survivors of workers enrolled in the Separate Pension Scheme (Article 2 (26) of Law 335/1995) are entitled to the supplementary indirect pension even if they are recipients of an indirect pension from AGO and the compulsory Social Security Schemes for the self-employed professionals.

HOW CAN I CLAIM?

The claim shall be submitted online to INPS by accessing the service with the personal credentials.

Alternatively, claims can be made by:

  • Calling the Contact centre on 803 164 (free from Italian landlines) or 06 164 164 from mobile phones;
  • on-line services offered by patronage institutes and intermediaries of the Institute

Processing times of the decision

The ordinary deadline for issuing a decision is set at 30 days under Law no. 241/1990. In some cases the law may set different deadlines.

The table shows the deadlines exceeding thirty days, set by the Institute with a Regulation.

In addition to the terms for the issuance of the decision, the table also indicates the relative manager.
