What is it?

The early pension “Opzione Donna”, provided for by the 2023 Budget Law, is a pension disbursed to female workers following a claim who, by 31 December 2022, have completed the required age and contribution requirements and who, on the date of the claim, are in one of the conditions indicated by law (caregivers, impaired persons who have been recognised as having a invalidity greater than 74%, employees or dismissed from companies with an active round table for the management of the corporate crisis).

How does it work?

START DATE AND DURATION

It is possible to obtain the Pension “Opzione Donna” after:

  • 12 months from the date the requirements are met, if the pension benefit is paid by pension schemes for employees;
  • 18 months from the date the requirements are met, if the benefit is paid by pension schemes for self-employed workers.

Pension benefits may not, however, commence before 2 January 2023.

Female workers in the school sector and in Higher Education in Art, Music and Dance (AFAM), upon meeting the requirements and conditions, may be entitled to the pension starting from 1 September and 1 November 2023, respectively.

Female workers who have met the requirements before 31 December 2022 may be entitled to the pension even after the first effective date, provided that the conditions required on the date of submission of the pension claim are met.

Claim

REQUIREMENTS

The early pension “Opzione Donna” is available to female workers who, by 31 December 2022, have accrued a contributory seniority equal to or greater than 35 years and at least 60 years of age.

The age requirement of 60 years old is reduced by one year per child up to a maximum of two years.

The maximum reduction of two years applies to the category of female workers employed or dismissed by companies for which there is an active round table for the management of the corporate crisis, even in the absence of any children. This category of female workers has access to the pension “Opzione Donna” with 58 years of age and 35 years of contributions, accrued by 31 December 2022.

Female workers, who meet the age and contribution requirements, can access the early pension “Opzione Donna” if they meet at least one of the following conditions:

  • assist, on the date of submission of the pension claim and for at least six months, the spouse or part of the civil partnership or a first-degree relative living with them with a severe disability pursuant to Article 3, paragraph 3, Law no. 1992/104, or a relative or a second-degree relative by marriage living with them if the parents, spouse or civil partner of the person with a severe disability have reached 70 years of age or are also suffering from disabling diseases or have died or are absent;
  • have reduced work capacity, ascertained by the committees for the recognition of civilian invalidity, for those with invalidity greater than or equal to 74%;
  • are female workers employed or dismissed from companies for which there is an active round table, for the management of the corporate crisis, at the corporate crisis facility referred to in Article 1, paragraph 852, of Law no. 296 of 27 December 2006. The round table must be active as at 1 January 2023 or it must have been activated on a later date. 

The conditions specified above, also with reference to the staff belonging to the school sector or that of Higher Education in Art, Music and Dance (AFAM), must exist on the date of submission of the pension claim and must not be subject to further verification at the start of the pension benefit.

The early pension “Opzione Donna” is calculated according to the calculation rules of the contributory system.

HOW CAN I CLAIM?

The claim to the INPS must be made online by using the dedicated service. Alternatively, claims can be made by:

  • phoning the Contact Centre on 803 164 (free from Italian landlines) or 06 164 164 from mobile phones;
  • On-line services offered by patronage institutes and intermediaries thereof.

Processing times of the decision

The ordinary deadline for issuing the decisions is set at 30 days as established by Law no. 241/1990. In some cases the law may set different deadlines.
